Summit in December won approval of a North Dakota storage site for carbon carried by its planned pipeline. Now that decision is being appealed.

A group of North Dakota landowners is appealing the state’s approval of an underground carbon storage area for Summit Carbon Solutions, the company attempting to build the world’s largest carbon capture and storage project.

A group of N.D. landowners filed an appeal on Thursday in Burleigh County District Court declaring that the North Dakota Industrial Commission violated state law and withheld critical information.

In North Dakota, under a process called amalgamation, if 60 percent of the landowners in a proposed carbon dioxide underground storage area agree to the plan, the state can force the other 40 percent to comply.
